1. Acceptance of Terms
By accessing or using the Mjengo Technologies platform and website ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
These Terms apply to all users of our platform, including contractors, property owners, clients, diaspora customers, and any other individuals who access the Services.
2. Description of Service
Mjengo Technologies Ltd ("Mjengo", "we", "us") provides a construction project management platform that enables:
- Contractors to manage projects, budgets, timelines, teams, and client communications.
- Clients and property owners to monitor project progress, track budgets, and manage milestone-based payments.
- Both parties to communicate transparently throughout the construction lifecycle.
We reserve the right to modify, suspend, or discontinue any part of the Services at any time with reasonable notice where practicable.
3. Account Registration
To access most features of our platform, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and accept responsibility for all activity under your account.
- Notify us immediately at [email protected] of any unauthorised use of your account.
- Not share your account credentials with any third party.
You must be at least 18 years of age to register an account. By registering, you represent and warrant that you meet this requirement.
4. Acceptable Use
You agree not to use the Services to:
- Upload or transmit any content that is unlawful, fraudulent, defamatory, obscene, or harmful.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Interfere with or disrupt the integrity or performance of the Services.
- Attempt to gain unauthorised access to any part of the Services or its related systems.
- Use the Services for any purpose that competes with Mjengo without our prior written consent.
- Engage in any automated data collection (scraping, bots) without express permission.
We reserve the right to suspend or terminate accounts that violate these Terms.
5. Project Data and Content
You retain all ownership rights to the data, photos, documents, and other content you upload to the platform ("User Content").
By uploading User Content, you grant Mjengo a limited, non-exclusive, royalty-free licence to store, display, and process that content solely for the purpose of providing the Services to you.
You are solely responsible for the accuracy, legality, and appropriateness of your User Content. We do not verify the accuracy of project data, budgets, or milestone claims.
6. Payments and Subscriptions
Subscription Plans
Access to certain features requires a paid subscription. Pricing is set out on our Pricing page and may change with 30 days' notice.
Billing
Subscriptions are billed monthly or annually in advance. By providing payment information, you authorise Mjengo to charge the applicable fees to your payment method.
Refunds
Subscription fees are non-refundable except where required by applicable law or at our sole discretion. If you cancel your subscription, you retain access until the end of your current billing period.
Milestone Payments
Mjengo facilitates milestone-based payment functionality between contractors and clients. Mjengo acts as a technology intermediary only. We are not a party to payment agreements between contractors and clients and accept no liability for disputes arising between them.
7. Intellectual Property
All intellectual property in the Mjengo platform, including but not limited to software, design, trademarks, logos, and documentation, is owned by or licensed to Mjengo Technologies Ltd. You may not copy, reproduce, distribute, or create derivative works from our IP without express written permission.
8. Third-Party Services
Our platform integrates with third-party services (payment processors, cloud storage, analytics providers). Your use of those services is subject to their respective terms and privacy policies. We are not liable for the actions or omissions of any third-party service provider.
9. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The Services will be uninterrupted, error-free, or secure.
- Any defects will be corrected.
- The platform is free of viruses or harmful components.
10. Limitation of Liability
To the maximum extent permitted by law, Mjengo Technologies Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Services.
Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
11. Indemnification
You agree to indemnify and hold harmless Mjengo Technologies Ltd, its directors, employees, and agents from any claims, liabilities, damages, or expenses (including legal fees) arising from your use of the Services, your User Content, or your violation of these Terms.
12. Termination
We may terminate or suspend your account immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Services ceases immediately.
You may cancel your account at any time through the account settings page or by contacting [email protected]. Cancellation does not entitle you to a refund of any prepaid fees.
13. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.

14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes by email or by posting a prominent notice in the platform. Continued use of the Services after the effective date of changes constitutes acceptance of the updated Terms.
